FY 2024 Upcoming H-1B Visa Filing Deadline
The first day a new H-1B visa can be registered to be filed is Wednesday, March 1, 2023, and the last day is Friday, March 17, 2023. Since persons who miss this year’s window will have to wait until March 2024 (a year later) to apply for a new H-1B, it is imperative for individuals or their employers to contact our office as soon as possible.
If an individual or a company wants the work in the U.S. to begin any time between October 1, 2023, and October 1, 2024, even if the individual is not currently in the U.S. or is a student in the U.S., then the individual or company should contact our office. Additionally, for an individual working in the U.S. in a different immigration status to continue working in the U.S. for the current or a prospective company, the individual and company should consider applying for an H-1B. Such immigration statuses include:
• employment authorization through schooling (e.g., OPT or CPT),
• employment authorization as dependent of a spouse’s status (e.g., H-4, L-2, J-2, E-2, or E-3D), or
• different status sponsored by the company or another company (e.g., TN, J-1, L-1, E-2, or E-3).

This deadline does not apply to individuals who already have H-1B visas and who are either extending their H-1B time or transferring their H-1B to another employer.
The H-1B is the most frequently obtained work permit for corporate employees. It is available to U.S. employers wishing to hire a foreign employee in a specialty occupation.
The law defines a specialty occupation as an occupation that normally requires a minimum of a U.S. bachelor’s degree, or its foreign equivalent, in a field related to the occupation. The government allows for work experience to count as the equivalent of a U.S. bachelor’s degree.
